Nevada Republican Party Resolution 2021-G101
Resolution to Censure Nevada Secretary of State Barbara Cegavske
Whereas, Nevada Revised Statute (NRS) 293.2546, declaration of voters’ rights, reads in part, “11. To have complaints about elections and election contests resolved fairly, accurately, and efficiently,” which the Nevada Secretary of State failed to ensure, causing voter’s civil rights to be stolen, resulting in numerous Republicans in Nevada indicating they will no longer actively participate in the Republican Party; and
Whereas, March 26, 2021, Nevada Assembly Republican Minority Leader Dr. Robin Titus’ Election Reform Update reads, “A significant number of Nevadans feel they were disenfranchised on November 3rd. While the courts and media would have everyone believe that there was no, or no significant, problems with voting in Nevada, The People have a right to know the facts. That requires investigations.”; and
Whereas, NRS 293.124, Paragraph 1 reads, “The Secretary of State shall serve as the Chief Officer of Elections for this State. As Chief Officer, the Secretary of State is responsible for the execution and enforcement of the provisions of Title 24 of NRS and all other provisions of state and federal law relating to elections in this State.” [Emphasis added]; and
Whereas, On November 17, 2020, former Nevada Attorney General Adam Laxalt, and Trump Campaign Attorney Jesse Binnall, publicly detailed evidence of voter fraud, alleging 80,000 ballots mailed to ineligible voters in Clark County after a failure to remove them from the active rolls, approximately 30 percent of mail-in ballots in Clark County counted by signature reading machines with no human verification, in violation of NRS 293.8874, Paragraph 1(a), numerous security, and observer access violations, and 400 affidavits of volunteer investigators; and
Whereas, On December 16, 2020, attorney Jesse Binnall made a statement under oath to the United States Senate Hearing on Election Security and Administration where he asserted the Trump Campaign in Nevada uncovered proof of: 42,000 double voters, 1,500 dead voters, 19,000 votes cast in Nevada by out of state residents, votes from 8,000 non-existent addresses, votes from 15,000 commercial / vacant addresses, votes from 4,000 non-citizens, all comprising more than 130,000 individual instances of voter fraud or irregularities and the Nevada Secretary of State still did not attempt to collect evidence, methodologies, or testimony from Nevada Republican Party investigators, or even begin an investigation of such accusations made under oath; and
Whereas, The Clark County Registrar of Voters failed to move 80,000 voters to inactive status as required after their 2020 Primary Election ballots were undeliverable, causing ballots to be sent to all 80,000, resulting in over 8,500 of them to being voted due to the Nevada Secretary of State failing her oversight duty to also identify and direct inactivation of these voters by Clark County; and
Whereas, NRS 293B.354, Paragraph 1 required the Clark County Registrar of Voters to submit a written plan for election observers by April 15, 2020, which was not submitted until mid- October 2020 and only then as a result of Nevada Republican Party legal actions, the Secretary of State asked Clark County to comply for six months rather than take all needed actions to ensure this plan for voting integrity, mandated by law, was completed; and
Whereas, the Nevada Republican Party offered to pay for security video for Clark County election facilities, such as is in use in Washoe County facilities, to ensure meaningful observation, a bedrock principle of credible elections, however the Nevada Secretary of State refused this wise no cost tool; and
Whereas, in a February 9, 2017 article, Secretary of State Barbara Cegavske was quoted as saying, “Nevada does have a problem with voter registration fraud and “it’s a lot bigger than people realize,” and over three years later, the “Voter Registration Verification Process” page on her Nevada Secretary of State website still offers no hope that citizenship verification is part of her office’s processes; and
Whereas, in a December 18th, 2020 article, Nevada Secretary of State Barbara Cegavske declared Nevada’s election results as reliable and accurate, further claiming election integrity violation reports and accusations with legitimate evidence are investigated, but not “unfounded accusations” or “anonymous declarations.” an arrogant claim she had no basis in fact to make due to not having requested access to, or examined the evidence cited November 17th, and December 16th by Trump Campaign Attorney Jesse Binnall; and
Whereas, On March 4, 2021 the Nevada Republican Party delivered 122,918 complaints detailed on 40,669 Election Integrity Violation Reports in both paper and electronic forms to the Nevada Secretary of State office and on March 16 the Nevada Secretary of State issued a press release mocking the submission by focusing on numbers of forms versus individual incidents, yet finally acknowledged some investigations were in progress, and others would occur; and
Whereas, The Nevada Secretary of State website on reporting election law violations reads, “The Secretary of State’s Office oversees Nevada’s Elections and is constantly monitoring elections activities.” while it is obvious this is not the case; now, therefore, be it
Resolved, Licensed attorneys appeared twice in national media, once under oath, testifying the Nevada Republican Party discovered voter fraud, their analysis, and the litigation commenced November 17th by the Trump Electors, were all clear signals requiring the Nevada Secretary of State investigate the claimed fraud, yet the Nevada Secretary of State communicated to the media that the election was flawless, not opening an investigation until the Nevada Republican Party submitted boxes of evidence to her office March 4, 2021, which is clearly indicative of negligence and misconduct of office and potentially causal in the lack of trust of the November election results; and
Resolved, The Nevada Republican Central Committee censures Nevada Secretary of State Barbara Cegavske for disregard of her oath of office by failing to investigate election fraud, her dismissive public statements regarding election integrity concerns, and her failure to ensure compliance with Nevada and federal election law, these actions being at least partially causal in November 2020 election irregularities and fraud; and
Resolved, The Nevada Republican Central Committee directs the Secretary of the Nevada Republican Party ensure a copy of this resolution is delivered to the Nevada Secretary of State, each Nevada Republican Legislator, and distributed for broad media coverage as directed by the Chairman.
